Terms of Service

These terms are a plain-language agreement between you and Maison Barton ("we", "us"), the maker of Clipthesis. By using the Clipthesis app or subscribing to Clipthesis Backup, you agree to them. If you don't agree, please don't use the software or the service.

1. What Clipthesis is

Clipthesis is a free macOS app for organising your own video and photo libraries. It runs entirely on your Mac: your media files, tags, collections, and library database stay on your own devices and drives, and the app works offline. You don't need an account to use the free app. If you choose to sign in, library sync — keeping your tags, collections, and clip metadata in step across your machines — is included free with every account.

2. What Clipthesis Backup is

Clipthesis Backup is an optional, paid add-on that stores copies of your media files in the cloud, so you can recover footage after a drive failure or download clips onto another machine. It requires an account and an active subscription. Backup data is stored with our storage provider, Backblaze B2, on servers located in the European Union.

Don't use Clipthesis Backup to:

If an account seriously or repeatedly violates these rules, we may suspend or terminate it. Where reasonably possible we'll warn you first and give you a chance to retrieve your data.

7. Availability and changes

Clipthesis is built and run by a very small team. We work hard to keep the service reliable, but we can't promise uninterrupted availability, and features may change, improve, or occasionally be removed. If we ever discontinue Clipthesis Backup entirely, we'll give you reasonable advance notice and a way to retrieve your data first.

8. Disclaimer of warranties

The free app and the backup service are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, our total liability for any claims arising out of or relating to the app or the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim (or $0 if you use only the free app). We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data. Nothing in these terms excludes liability that cannot be excluded under applicable law.

10. Termination

You can stop using Clipthesis at any time. We may terminate or suspend access to Clipthesis Backup for material breach of these terms as described in section 6. Sections that by their nature should survive (such as sections 8, 9, and 12) survive termination.

11. Changes to these terms

We may update these terms from time to time. For material changes we'll give notice — by email to subscribers and/or a notice on this site — before the changes take effect. Continuing to use the service after that means you accept the updated terms.

12. Governing law

These terms are governed by the laws of France, and disputes will be resolved in the courts of France, without affecting any mandatory consumer protections you have where you live.
