Terms of Service
These terms are a plain-language agreement between you and Maison Barton ("we", "us"), the maker of Clipthesis. By using the Clipthesis app or subscribing to Clipthesis Backup, you agree to them. If you don't agree, please don't use the software or the service.
1. What Clipthesis is
Clipthesis is a free macOS app for organising your own video and photo libraries. It runs entirely on your Mac: your media files, tags, collections, and library database stay on your own devices and drives, and the app works offline. You don't need an account to use the free app. If you choose to sign in, library sync — keeping your tags, collections, and clip metadata in step across your machines — is included free with every account.
2. What Clipthesis Backup is
Clipthesis Backup is an optional, paid add-on that stores copies of your media files in the cloud, so you can recover footage after a drive failure or download clips onto another machine. It requires an account and an active subscription. Backup data is stored with our storage provider, Backblaze B2, on servers located in the European Union.
3. Pricing and billing
- Clipthesis Backup costs $0.01 per GB per month. Your stored data is metered daily and billed monthly in arrears — you pay only for what you actually store, with no tiers and no minimums.
- Payments are processed by Stripe. Your card details go directly to Stripe; we never see or store your card numbers.
- A valid payment method is required to subscribe, but nothing is charged until you have stored data.
- Prices may change. If they do, we'll give existing subscribers reasonable advance notice before a new price applies to them.
4. Cancelling, retention, and deletion
- You can cancel at any time from the billing portal in the app (Settings → Account → Manage billing). Cancellation takes effect at the end of the billing period, and your final invoice covers only the storage used up to then.
- If you cancel, your backup data is permanently deleted when the subscription ends (at the end of your final billing period). Download or restore anything you want to keep before then.
- If a payment fails, your backup data is kept for a 16-day grace period from the failed payment. A successful payment during those 16 days cancels the deletion; otherwise the data is permanently deleted.
- You can request complete deletion of your backup data at any time by contacting us at support@clipthesis.com. Deletion is permanent and cannot be undone.
5. Your content and responsibilities
- Your media stays yours. We claim no ownership of anything you back up; you grant us only the limited right to store, transmit, and return it to you, which is what operating a backup service requires.
- Only back up content you have the right to store. You are responsible for the contents of your backups.
- Keep your account credentials secure. Actions taken through your account are your responsibility.
- Clipthesis Backup is a safety net, not your only copy. As with any backup service, we recommend keeping your original files too.
6. Acceptable use
Don't use Clipthesis Backup to:
- store or distribute content that is illegal in France or in the place where you live;
- store content that infringes someone else's rights;
- abuse, probe, or disrupt the service, circumvent metering or billing, or resell the service;
- use the service as general-purpose file hosting for the public rather than personal media backup.
If an account seriously or repeatedly violates these rules, we may suspend or terminate it. Where reasonably possible we'll warn you first and give you a chance to retrieve your data.
7. Availability and changes
Clipthesis is built and run by a very small team. We work hard to keep the service reliable, but we can't promise uninterrupted availability, and features may change, improve, or occasionally be removed. If we ever discontinue Clipthesis Backup entirely, we'll give you reasonable advance notice and a way to retrieve your data first.
8. Disclaimer of warranties
The free app and the backup service are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claims arising out of or relating to the app or the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim (or $0 if you use only the free app). We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data. Nothing in these terms excludes liability that cannot be excluded under applicable law.
10. Termination
You can stop using Clipthesis at any time. We may terminate or suspend access to Clipthesis Backup for material breach of these terms as described in section 6. Sections that by their nature should survive (such as sections 8, 9, and 12) survive termination.
11. Changes to these terms
We may update these terms from time to time. For material changes we'll give notice — by email to subscribers and/or a notice on this site — before the changes take effect. Continuing to use the service after that means you accept the updated terms.
12. Governing law
These terms are governed by the laws of France, and disputes will be resolved in the courts of France, without affecting any mandatory consumer protections you have where you live.
